These Terms of Service ("Terms") govern your access to and use of the Cuteness Calculator website, its features, and the AI-powered services we provide (collectively, the "Service"). The Service is an entertainment tool designed to be fun, fast, and socially shareable.

The Service is intended purely for fun and entertainment purposes and should not be considered a scientific, objective, or serious evaluation of any individual's appearance.

Key features of the Service include:

  • AI-Powered Analysis: Users can upload a photo or capture one using their device's camera to receive an AI-generated analysis.
  • Generated Results: The analysis produces several outputs, including a cuteness score, a percentile ranking, a short AI-generated comment, and a fixed response to the question "Am I Cute or Not?".
  • Platform Accessibility: The Service is free to use, fully browser-based, and accessible on any modern device with a web browser, such as laptops, desktops, tablets, and smartphones.
  • Global and Multilingual: The Service is available to users worldwide and automatically adapts its content to the user's browser language settings, with English as the default.

2. User Eligibility

To use the Service, you must be at least 13 years of age. If you are between the ages of 13 and 18 (or the age of legal majority in your jurisdiction), you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Acceptable Use and User Conduct

You are solely responsible for your conduct and any data, text, information, images, photos, and other content ("User Content") that you submit, post, and display on the Service. You agree to use the Service in compliance with all applicable local, state, national, and international laws, rules, and regulations.

When using the Service, you agree NOT to:

  • Upload, post, or transmit any User Content that is unlawful, harmful, defamatory, obscene, infringing, harassing, or otherwise objectionable.
  • Upload photos of any person other than yourself unless you have obtained their explicit, verifiable consent to do so.
  • Upload User Content that infringes on any patent, trademark, trade secret, copyright, right of publicity, or other intellectual property right of any other person or entity.
  • Upload any content that is not a clear, front-facing photograph of a single, real human face. Prohibited content includes, but is not limited to:
    • Group photos or images with multiple faces.
    • Non-human subjects such as animals, cartoons, anime, avatars, or objects.
    • Artificially created or AI-generated faces.
    • Blurry, low-quality, or heavily pixelated images.
    • Photos where the face is significantly obstructed by masks, sunglasses, hair, or heavy filters.
    • Full-body or side-profile shots where the face is not the central focus.
  • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Use the Service for any commercial purpose or for the benefit of any third party without our prior written consent.
  • Attempt to interfere with, disrupt, or compromise the integrity or security of the Service, its servers, or networks.

We reserve the right, but are not obligated, to monitor and review User Content and to remove any content that, in our sole discretion, violates these Terms.

4. User Content and Sharing

4.1. Ownership and License Grant

You retain all ownership rights to the User Content you upload to the Service. However, by submitting User Content, you grant Cuteness Calculator a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, process, modify, display, and distribute your User Content solely for the purposes of operating, developing, providing, and improving the Service. This license is necessary for us to perform the AI analysis, generate results, and facilitate your chosen sharing options.

4.2. Sharing Options

The Service provides two distinct modes for sharing your results:

  • Private Share: If you choose this option, the Service generates a downloadable image of your result. The generated image and your original photo are not stored on our servers. It is your responsibility to download this image if you wish to keep it or share it manually on other platforms.
  • Public Share: To share your result publicly, you must provide explicit consent by checking a checkbox. This action confirms that you agree to have your User Content (the uploaded photo, your optional caption, and the AI-generated results) made publicly accessible via a unique URL. It also confirms your acceptance of these Terms and our Privacy Policy. Publicly shared content is intended to remain accessible for three (3) days. This period may be extended based on public engagement with your shared content.

4.3. Content Removal

Notwithstanding the stated three (3) day accessibility period for public shares, Cuteness Calculator reserves the absolute right to remove any publicly shared User Content at any time, for any reason or for no reason, without prior notice. Reasons for removal may include, but are not limited to, a violation of these Terms, a valid report from a third party, or any content we deem inappropriate in our sole discretion.

5. AI Scoring and Analysis

The AI analysis and scoring are based on a proprietary algorithm that evaluates various factors, such as image clarity, lighting, facial expression, and presentation. These criteria are subjective and are subject to change over time, potentially on a daily, monthly, or random basis, without notice. The results are not guaranteed to be accurate, consistent, or repeatable and should be treated as a form of entertainment only. 6. Newsletter Subscription

Cuteness Calculator may offer an optional newsletter subscription to keep users informed of website updates. By providing your email address and subscribing, you consent to receive periodic electronic communications from us. Your use of this feature is governed by our Privacy Policy.

7. Intellectual Property Rights

Excluding your User Content, all aspects of the Service, including the website design, text, graphics, logos, AI models, and underlying source code, are the exclusive property of Cuteness Calculator and its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service or its intellectual property.

8. Disclaimers and No Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that:

  • The results, scores, or comments generated by the Service will be accurate, reliable, or meet your expectations.
  • Any errors or defects in the Service will be corrected.

YOU ARE SOLELY RESPONSIBLE FOR ANY CONTENT YOU UPLOAD. CUTENESS CALCULATOR HAS NO RESPONSIBILITY OR LIABILITY FOR USER CONTENT, INCLUDING INSTANCES WHERE A USER UPLOADS A PHOTO OF ANOTHER INDIVIDUAL WITHOUT THEIR PERMISSION.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CUTENESS CALCULATOR, ITS AFFILIATES, DIRECTORS, EMPLOYEees, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the website owner is based, without regard to its conflict of law provisions.
